Welcome to Nearby Cars. By accessing or using our website, mobile app, or related services (collectively, the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

1. About Nearby Cars

Nearby Cars is a marketplace platform that connects buyers and sellers of vehicles. We provide listing, search, map discovery, categories, messaging, offers, ratings, and location-based tools. Nearby Cars is not a dealer, broker, insurer, or financial institution. We do not own the vehicles listed and are not a party to transactions between users.

2. Eligibility

You must be at least 18 years old and legally able to enter a binding contract to use the Service. You are responsible for ensuring that your use of Nearby Cars complies with laws in your country or region.

3. Your account

• You must provide accurate registration information and keep your login credentials secure.
• You are responsible for all activity under your account.
• You agree to verify your account using the OTP or verification methods we provide.
• We may suspend or terminate accounts that violate these terms, our Safety Guidelines, or applicable law.

4. Listings and user content

When you post a listing or other content, you represent that:

• You have the right to sell or advertise the vehicle and the information is truthful to the best of your knowledge.
• Photos and descriptions accurately reflect the vehicle offered.
• Your listing complies with local laws, including any required disclosures.
• You will not post duplicate, misleading, or fraudulent listings.

You grant Nearby Cars a non-exclusive license to display, distribute, and promote your content on the Service. We may remove listings that are reported, suspected of fraud, or violate our policies.

5. Transactions between users

Buyers and sellers negotiate price, payment, inspection, registration, and delivery directly with each other. Nearby Cars does not process vehicle payments, hold escrow, or guarantee that a sale will complete. Any agreement is solely between the buyer and seller.

6. Messaging, offers, and ratings

In-app chat, price offers, and seller ratings are provided to facilitate communication. You agree not to use chat for harassment, spam, or sharing sensitive financial data such as passwords or OTP codes. We may review reported messages to enforce our policies.

7. Location and country settings

The Service uses GPS and country settings to show nearby listings and match you to the correct marketplace. Location data is used as described in our Privacy Policy. You may disable location in your device settings, but some features may not work correctly.

8. Business profiles

Dealers and businesses may apply for verification to display business information on their profile. Verified business profiles must provide accurate business details, hours, and contact information. Nearby Cars may revoke verification if information is misleading or policies are violated.

9. Prohibited conduct

You may not:

• Post false, stolen, or misleading listings.
• Impersonate another person or misrepresent vehicle ownership.
• Use the Service for harassment, spam, or unlawful activity.
• Scrape, reverse engineer, or overload the Service.
• Circumvent security, reporting, or moderation systems.
• Use the Service for discriminatory or abusive purposes.

10. Reports and moderation

Users may report listings or behaviour they believe violates these terms. We may investigate reports, remove content, restrict accounts, or take other action we consider appropriate. We are not obligated to monitor all user activity but may do so to protect the platform and its users.

11. Intellectual property

The Nearby Cars name, logo, software, and design elements are owned by Nearby Cars or its licensors. You may not copy or use our branding without permission.

12. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee listing accuracy, vehicle condition, user identity, or uninterrupted availability. Use your own judgment and due diligence before meeting anyone or completing a purchase.

13. Limitation of liability

To the fullest extent permitted by law, Nearby Cars and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service or any transaction between users.

14. Changes to these terms

We may update these Terms of Service from time to time. We will post the updated version on this page. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
